Various laws have been passed internationally to facilitate trade by using electronic records and signatures in interstate and foreign trade. The aim is to ensure the validity and legal effect of contracts concluded electronically. For example, the U.S. code defines an electronic signature for the purposes of U.S. law as “an electronic sound, symbol or process associated with, or logically related to, a contract or other data set, executed or accepted by a person with the intention of signing the data set.”  This may be an electronic transmission of the document containing the signature, as in the case of facsimile transfers, or encrypted messages such as morsecode telegraphy. Canadian law (PIPEDA) seeks to clarify the situation by first defining a generic electronic signature as “a signature consisting of one or more letters, characters, numbers or other digital symbols embedded in an electronic document, attached to or linked to an electronic document,” and then defining a secure electronic signature as an electronic signature with certain characteristics. The secure rules for PIPEDA`s electronic signatures refine the definition as a digital signature, which is applied and verified in some way.
